4.1. PERMISSION FOR RESIDENCE OVER A DESIGNATED PERIOD
A citizen of a third party state may seek the granting of permission for temporary stay if circumstances arise justifying the foreigner’s residence in the Republic of Poland for a period longer than 3 months. These prerequisites have been specified in detail by the regulations of the Act on foreigners. Among others, this relates to situations when:
the purpose of stay is to work in Poland on the basis of a contract with an employer based in Poland - separate types of permits may then apply - permit for stay and work and permit for stay to work in a profession requiring high skills, or
the purpose of stay is delegation to work in Poland and a foreigner possesses a work permit - a separate specific type of permit may then apply - permit for temporary stay for work by a foreigner delegated by a foreign employer to Poland) , or
the purpose of stay in Poland is business based on regulations binding in this regard in Poland - a permit for a temporary stay to conduct business applies, or
the purpose of stay in Poland is education in the first or second level of study or uniform master’s degree studies or third level study - a permit for temporary state for education applies, or
the purpose of stay in Poland is scientific or development studies based on a contract to hire an academic to carry out a research project with a scientific institution, as noted in art. 2 point 9 of the Act to dated 30 April 2010 on the financing of education, as approved for this purpose by the Minister for Education on the basis of a decision - a permit for temporary stay for research work applies, or
the purpose of stay in Poland is family unification or visit - a permit for temporary stay for family members of Polish citizens and family members of foreigners applies
A permit for temporary stay can also be sought by a citizen of a third country, who:
intends to undertake or continue study or professional training in Poland, or
is a graduate of a Polish university and is seeking work in Poland, or
is clergy, member of a monastery or a person holding a religious post in a church or religious denomination whose status is regulated by an international treaty, provisions of Polish law or who acts on the basis of entry in the register of churches and other religious denominations, and if stay in Poland relates to a held function or preparation thereto, or
who has presented other circumstances justifying stay in the Republic of Poland.
Competent body, deadlines and procedure
An application for a permit for temporary stay should be filed personally with the provincial governor competent for the third party state citizen place of residence in Poland. If an application for a permit for temporary stay has not been filed personally, the provincial governor calls for personal appearance within seven days under the penalty of an application being refused to be processed. The foreigner must submit an application during stay in Poland. A provincial governor may refuse to initiate proceedings if a foreigner was abroad at the time of filing an application.
An application to grant a permit for temporary stay should be filed by the last day of legal stay of a foreigner in Poland. If this deadline has been met and an application has no formal deficiencies or such deficiencies have been corrected on time, the provincial governor places a stamp in the foreigner’s travel document confirming the submission of an application for a temporary stay permit and, moreover, a foreigner’s stay in Poland is deemed legal from the date of a submitted application to the date when a decision on granting a permit for temporary stay becomes final.
Permission for temporary stay is granted on each occasion for the period indispensable for attainment of the purpose of stay in the Republic of Poland, as to principle for no longer than three years. A residence card is issued as the result of issue of permission for temporary stay, valid for the period designated in the permission, and which the citizen of third party state must collect in person from the provincial governor issuing it.
As to principle, the procedure should be completed within a period not exceeding two months from the date of fling the application.
Правильно ли я понимаю, что, например, я въехал в Польшу по шенгенской турвизе, зарегистрировал ООО, открыл счет в банке и снял жилье, после чего обращаюсь за ВНЖ?
Дальше, на той же странице идет речь о "permission for stay by long-term EU resident" - видимо это и есть ПМЖ, т.к. он выдается на неограниченный срок.О ПМЖ здесь идет речь?

4.3 PERMISSION FOR STAY BY LONG-TERM EC RESIDENT
A citizen of third party state can be granted permission for stay by long-term EU resident, if the foreigner has stayed on Republic of Poland territory legally and uninterruptedly before filing an application for at least 5 years and has (with certain exceptions):
a stable and regular source of income sufficient to cover the living costs of the foreigner and family members maintained by the foreigner;
health insurance in the meaning of the regulations on universal health insurance or confirmation of cover by an insurer of costs of treatment in the Republic of Poland.
Stay in the Republic of Poland is regarded as uninterrupted, with certain exceptions, when no break therein has been for longer than 6 months and total breaks have not exceeded 10 months in aggregate.
Competent body, deadlines and procedure
An application for granting of permission for stay by long-term EU resident should be filed with the provincial governor competent for the citizen of third party state place of stay solely during a stay in the Republic of Poland that is in accordance with the law (applications filed abroad are not considered).
Permissions for stay by long-term EU resident are granted for an unlimited period. As a result of issue of permission for stay by long-tern EU resident, a residence card is issued valid for 5 years, which the citizen of third party state must collect in person from the provincial governor issuing it. As to principle, the procedure should be completed within a period not exceeding 3 months from the date of filing application.
Required documents
In seeking issue of permission for long-term EU residence, a citizen of third party state is obliged to file i.a. the following:
completed application form for granting permission for long-term EU residence;
photographs;
confirmation of payment of fee;
confirmation of registration of stay in Poland (if applicable);
legal title to occupy housing accommodation where the foreigner resides or intends to reside (e.g. a lease contract), if this is required for the given purpose;
copies of the travel document (along with original to present);
documents proving uninterrupted stay in Poland;
documents confirming that a foreigner has a stable and regular source of income sufficient to cover the costs of support of the foreigner and dependent family members;
a document confirming that a foreigner has medical (health) insurance entitling him/her to benefits in kind in the Republic of Poland;
other documents indispensable to confirm the data contained in the application and circumstances justifying seeking of permission for long-term EU residence for the said purpose.
На той же странице указан еще один статус "permission to settle" - это что за зверь? Не ПМЖ, а типа убежище, как для беженцев? Только там срок проживания в стране не 5, а 10 лет. В частности,

A citizen of third party state can be granted permission for permanent stay if the foreigner fulfils one of the following conditions:
-has resided in Poland without interruption for at least ten years immediately prior to the submission of an application for a permanent stay permit on the basis of consent to tolerated stay granted on the basis of art. 351 points 1 or 3 of the Foreigner Act...

Уважаемый Deniszaj, Вы подняли очень интересную тему! Присоединяюсь к вопросу о Вашем опыте получения ВНЖ - Вы по студ визе учитесь или у Вас вышеуказанный "permission for residence"? Как долго оформляли, как вообще с бюрократией в Польше? Как в России или чуть получше?
Есть ли разница, в каком воеводстве получать ВНЖ? Нет ли разговоров о том, что установленный порядок выдачи ВНЖ/ПМЖ могут прикрыть?
Можете ли сбросить первоисточники (законодательство) по ВНЖ на польском?
