Получают ли американское гражданство дети сотрудников консульских учреждений России, которые родились в США, в частности, технических сотрудников?

Дети, родившиеся в США автоматически становятся гражданами. Исключение лишь для младенцев, чьи родители являются сотрудниками дипломатических миссий других стран.

Да, это я знаю. Дело в том, что, например, административно-технический состав и обслуживающий персонал Посольства в Вашингтоне обладает таким же иммунитетом, что и дипломатический персонал вследствие двустороннего соглашения в 1979 году, поэтому их дети тоже не становятся гражданами. Но похожего соглашения, где бы полный иммунитет (от уголовной и гражданской юрисдикции) давался техническому составу из Генконсульства, я не видел. А без полного иммунитета, ребенок автоматически получает гражданство (Child born subject to the jurisdiction of the United States. A child born in the United States is born subject to the jurisdiction of the United States and is a United States citizen if the parent is not a “foreign diplomatic officer” as defined in paragraph (a)(2) of this section. This includes, for example, a child born in the United States to one of the following foreign government officials or employees:
1) ... (про людей с неполным иммунитетом в дипмиссиях и международных организациях);
(2) Foreign government employees with limited or no diplomatic immunity such as consular officials named on the State Department list entitled “Foreign Consular Officers in the United States” and their staffs.

В реальности этот закон не работает так как сертификат о рождениее выдает штат (иммиграционые вопросы находяться вне его юрисдикции), а в анкете на Сошиал Секьюрити вопроса про статус родителей нет. Поэтому в реальности дети дипломатов (при желании) получают паспорт. Да, про это я тоже читал https://cis.org/Report/Birthright-Citiz ... -Diplomats. Но там говорится про лазейку, которую используют люди, которые никогда и не имели такое право, потому что родители были дипломатическими работниками или людьми с похожим иммунитетом (т.е criminal jurisdiction + civil and administrative jurisdiction).

“Under international law, diplomatic agents are immune from the criminal jurisdiction of the receiving state. Diplomatic agents are also immune, with limited exception, from the civil and administrative jurisdiction of the state. The immunities of diplomatic agents extend to the members of their family forming part of their household. For this reason children born in the United States to diplomats to the United States are not subject to U.S. jurisdiction and do not acquire U.S. citizenship under the 14th Amendment or the laws derived from it."

Not all diplomats or employees of certain designated international organizations admitted to the United States as an A or G nonimmigrant have full diplomatic immunity and appear on the Blue List. For example, the immunities that apply to a foreign consular officer are not the same as those that apply to diplomats. In order to determine eligibility to register for permanent residence based on being born in the United States in diplomatic status, the applicant must submit official confirmation of the diplomatic classification and occupational title of his or her parent at the time of birth.

USCIS confirms with the Department of State whether the applicant’s parent(s) was on the Blue List at the time of the child’s birth. If an applicant did not have a parent on the Blue List at the time of his or her birth in the United States, then the applicant is a U.S. citizen because the applicant did not have full diplomatic immunity and was therefore subject to U.S. jurisdiction at the time of birth.

По иммиграционному законодательству не достаточно иметь только полный иммунитет от уголовной юрисдискции, чтобы не получить гражданство (по Венской конвенции у administrative and technical staff полный иммунитет от уголовной юрисдикции, но у них только функциональный иммунитет от административной и гражданской юрисдикций).

Я знаю лично людей, родившихся у родителей-дипломатов в США, которые получили гражданство США. Причем некоторым уже 50 лет, то есть они в 70-е годы родились и прекрасно прожили пол жизни в СССР с гражданством сша.
